 3.⁠ ⁠Eligibility to Train

 

To participate in any training you must:

•Hold a valid UK motorcycle licence or appropriate entitlement for the training

•Meet any minimum age requirements

•Be medically fit to ride and train

•Not be under the influence of alcohol, drugs, or medication that may impair your ability to ride safely

 

We reserve the right to refuse or terminate training if we believe continuing would pose a risk to you, the instructor, or others.

 4.⁠ ⁠Bookings and Payment

•All bookings are subject to availability

•Prices are stated in GBP (£) and include VAT where applicable

•Full payment is required in advance unless otherwise agreed in writing

•A booking is only confirmed once payment has been received

 

In accordance with the Consumer Rights Act 2015, our services will be provided with reasonable care and skill.

 5.⁠ ⁠Cancellation and Refund Policy

 

5.1 Cancellations by You

•You may cancel or reschedule a booking by giving at least 72 hours notice

•Cancellations made within this period may be subject to a full or partial charge

•Failure to attend a booked session without notice will normally result in the full fee being charged with no refund

 

Refunds are issued at our discretion and in line with UK consumer law.

 

5.2 Cancellations by Us

 

We may cancel or reschedule training due to:

•Unsafe weather conditions

•Instructor illness or unavailability

•Mechanical or safety issues

•Events outside our reasonable control

 

If we cancel a session, you will be offered either a rescheduled date or a full refund.

 6.⁠ ⁠Safety and Conduct

•You must follow all safety instructions given by the instructor

•Dangerous, reckless, or abusive behaviour will result in immediate termination of the session

•No refund will be given where a session is terminated due to your conduct

 

You are responsible for riding within your own ability and limits at all times.

 7.⁠ ⁠Motorcycles and Equipment

•You must treat motorcycles belonging to 121 MOTOSKILLS with care

•If using your own motorcycle, it must be roadworthy, legal, taxed, insured, and have a valid MOT where required

•You must wear appropriate protective equipment at all times, including:

•Approved helmet

•Gloves

•Boots

•Protective clothing

 

We are not responsible for damage to your own motorcycle or equipment unless caused by our negligence.

 8.⁠ ⁠Damage to School Motorcycles

•Motorcycles provided by 121 MOTOSKILLS remain the property of 121 MOTOSKILLS at all times

•Students are responsible for taking reasonable care of any motorcycle provided to them during training

•Where damage is caused to a school motorcycle as a result of the student’s actions, including loss of control, misuse, failure to follow instructor instructions, negligence, or reckless behaviour, the student will be liable for the cost of repair or replacement

•This may include, but is not limited to:

•Insurance excesses

•Repair costs not covered by insurance

•Recovery or transport costs

•Normal wear and tear is excluded from student liability

•Any liability will be assessed fairly, taking into account the circumstances of the incident and the terms of our insurance policy

 

Nothing in this section affects your statutory rights under UK law.

 9.⁠ ⁠Assumption of Risk

 

You acknowledge that motorcycling is an inherently hazardous activity. By participating in training with 121 MOTOSKILLS, you accept that:

•Riding a motorcycle carries a risk of injury, death, or property damage

•Training reduces risk but cannot eliminate it entirely

•You voluntarily accept these risks

10.⁠ ⁠Liability

 

Nothing in these Terms limits or excludes liability for:

•Death or personal injury caused by our negligence

•Fraud or fraudulent misrepresentation

•Any liability which cannot be limited under UK law

 

Subject to the above:

•We are not liable for loss or damage caused by factors outside our reasonable control

•We are not liable for indirect or consequential losses

•Our liability is limited to the cost of the training session purchased

•121 MOTOSKILLS holds an insurance policy that covers school motorcycles used by trainees during training sessions

•This insurance may be subject to policy terms, conditions, and excesses

•Our insurance does not cover damage to your own motorcycle or personal equipment

During training we may take photographs or videos for marketing or promotional purposes.
